These Terms and Conditions (“Terms”) govern your access to and use of the websites, platforms, digital products, content, subscriptions, communities, coaching, education, and related services provided by Julia Serafina and/or Serafina Digital (“we”, “us”, “our”). Our services may be delivered via our website(s), Kajabi, Stan Store, email, community platforms, video conferencing tools, or other platforms we use to deliver digital content and education (collectively, the “Services”). By accessing, purchasing, or using our Services, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use our Services.

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to access or purchase our Services. By using our Services, you warrant that you have legal capacity to enter into a binding agreement and that all information you provide is accurate and complete.

We are based in Australia. These Terms are governed by the laws of Queensland, Australia, including the Australian Consumer Law (ACL). We offer Services globally. If you access our Services outside Australia, you are responsible for complying with applicable local laws and regulations, and mandatory consumer protections in your jurisdiction will apply where required by law. Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or other applicable mandatory consumer laws.

All products offered through our Services are provided exclusively in digital format. We do not supply physical, printed, or hard-copy materials, and no goods are shipped, posted, or mailed. Delivery of digital products occurs via electronic download, online access, or platform-based access only. By purchasing from us, you acknowledge and agree that you are not purchasing any physical or printed goods and that access or delivery is deemed complete once digital access is provided.

All digital products and content are provided under a limited, non-exclusive, non-transferable, revocable licence for personal or internal business use only, unless expressly stated otherwise. You must not resell, sublicense, share, distribute, reproduce, upload, or make content available to third parties, or use content for commercial redistribution or resale, without our prior written consent.

Our Services may incorporate or reference artificial intelligence (AI), automation, or algorithmic tools, including AI-generated content, prompts, images, workflows, or recommendations. You acknowledge and agree that AI-generated outputs may be inaccurate, incomplete, or unpredictable, that AI outputs are provided for educational and informational purposes only, that you are solely responsible for reviewing, verifying, and applying any AI-generated content, and that we do not warrant the accuracy, completeness, or suitability of AI outputs for any purpose. To the maximum extent permitted by law, we disclaim all liability arising from reliance on AI-generated outputs or automated tools provided through our Services.

We may provide online education, training, coaching, mentoring, group programs, workshops, webinars, or strategy sessions. All such services are provided for general educational purposes only. We do not guarantee financial results, income, business growth, or performance outcomes. Results depend on individual effort, application, experience, and circumstances. Nothing provided constitutes legal, financial, medical, psychological, or professional advice.

Subscriptions or memberships may be billed on a recurring basis monthly, quarterly, or annually. You may cancel at any time via your account dashboard. Cancellation stops future billing only. Access continues until the end of the paid billing period. No refunds are provided for unused subscription periods, except where required by law.

We may promote or provide access to third-party or affiliate products. Third-party products are governed by their own terms. We are not responsible for third-party product quality, delivery, or support, and any disputes must be resolved directly with the provider.

Payments are processed securely via third-party providers such as Stripe, PayPal, Kajabi, or Stan Store. We do not store payment details. Prices are displayed in AUD or USD unless stated otherwise and may change without notice. International purchases may be subject to currency conversion or bank fees.

REFUND POLICY (DIGITAL PRODUCTS AND SERVICES)
Due to the digital nature of our products and services, all sales are final and change-of-mind refunds are not offered, except where required by law. Once digital access has been provided, the product is deemed delivered. Under the Australian Consumer Law, you may be entitled to a refund, repair, or replacement if a product is faulty, not as described, or not fit for purpose. Nothing in this Refund Policy excludes your statutory consumer rights. If a verified technical issue prevents or unreasonably delays access, your sole remedy will be a replacement or refund, at our discretion.

All content provided through our Services, including text, graphics, branding, logos, videos, audio, templates, software, and AI-assisted content, is owned by or licensed to us and protected under Australian and international intellectual property laws. Nothing in these Terms transfers intellectual property rights to you. Unauthorised use may result in termination of access and legal action.

If you submit feedback, ideas, or materials, you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, and distribute such submissions, and you warrant that your submissions do not infringe third-party rights.

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, revenue, or opportunity. Nothing limits rights under the Australian Consumer Law. You agree to indemnify and hold us harmless from claims arising from misuse of Services, breach of these Terms, or violation of third-party rights.

Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. We may suspend or terminate access to our Services if we reasonably believe you have breached these Terms. We may update these Terms at any time, and continued use constitutes acceptance of the updated Terms.
